Terms and Conditions

  1. About these terms

These terms and conditions apply to all purchases and bookings made through drnicolasutton.com, operated by Dr Nicola Sutton. This includes digital products (such as the Shout Less Toolkit and the Shout Less Foundation) and 1:1 sessions (the Reset Session and Break the Loop).

By purchasing a digital product or booking a session, you agree to these terms. Please read them carefully before completing your purchase or booking.

Different sections apply to different types of purchase. Section 4 covers digital products. Section 5 covers 1:1 sessions. Sections 6 onwards apply to everything.

  1. Who these products and sessions are for

All digital products and 1:1 sessions offered through drnicolasutton.com are designed for adults aged 18 and over. By purchasing or booking, you confirm that you are at least 18 years old.

The content and sessions offered here are educational and coaching in nature. They are not a substitute for professional support. If you are in crisis or need urgent help, please contact your GP, call 999, or reach out to Samaritans on 116 123.

  1. Digital products

What you are buying

When you purchase or sign up for a digital product, you are buying access to educational content. This may include video content, written materials, email sequences, downloadable worksheets, or other digital resources as described on the product page.

Important disclaimer

All digital products sold through drnicolasutton.com are educational resources only. They are not a substitute for professional support and do not create any professional relationship between you and Dr Nicola Sutton.

Results are not guaranteed and will vary from person to person. The content is based on evidence-based principles but is educational in nature. Dr Nicola Sutton accepts no liability for any outcomes resulting from use of the products.

Your right to cancel and digital content waiver

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your purchase within 14 days without giving any reason.

However, because our products are digital content delivered immediately on purchase, you will be asked at checkout to confirm that you want immediate access and that you understand this means you waive your 14-day right to cancel. This confirmation is required to complete your purchase.

If you do not provide this confirmation, your product will not be made available to you until the 14-day cancellation period has expired.

Nothing in this clause affects your statutory rights in relation to faulty or misdescribed digital content.

Refund policy — digital products

Where the digital content waiver has been confirmed at checkout, we offer a 7-day money-back guarantee from the date of purchase as a gesture of goodwill. If you are not satisfied with your purchase, you may request a full refund within 7 days by emailing [email protected]. Refunds will be processed within 14 working days of the request being approved.

After the 7-day period, no refunds will be issued. Free products are not eligible for refunds.

We reserve the right to refuse a refund where there is evidence of misuse, abuse of the guarantee, or breach of these terms.

Access to digital products

Once payment is confirmed or you have signed up for a free product, you will receive access via email and/or the Kajabi platform. It is your responsibility to ensure you provide a valid email address at the point of purchase.

Access to products is for the purchaser only. You are responsible for keeping your login details secure and must not share access with others. We reserve the right to revoke access if these terms are breached.

Intellectual property

All content within our digital products remains the intellectual property of Dr Nicola Sutton. This includes but is not limited to course materials, videos, worksheets, email content, and downloadable resources. Products are for your personal use only. You must not:

  • copy, share, redistribute, or reproduce any content
  • resell or make available any content to any third party in any form
  • record, screenshot, or download content beyond what is expressly provided
  • create derivative works based on the content
  • use the content to create a competing product or service

Any breach of this clause may result in immediate revocation of access without refund and may result in legal action.

Subscriptions

Where a product is offered on a subscription basis, you may cancel your subscription at any time by emailing [email protected]. Your access will continue until the end of the billing period in which you cancel. No refund will be issued for any unused portion of a subscription period unless required by law.

Subscription prices may change with reasonable notice. We will notify you of any changes before they take effect.

  1. 1:1 sessions

This section applies to the Reset Session (single session) and Break the Loop (eight-session programme).

Booking

Sessions are booked through our Microsoft Bookings system. A booking is confirmed once you receive a confirmation email. You will also receive a short prep form to complete before your first session. This helps us make the most of our time together.

Prep form

The prep form is used for session preparation only. Your responses are stored securely in our password-protected project management system and are accessible only to Dr Nicola Sutton. Information shared in the prep form is treated with the same confidentiality as information shared in sessions. Records are retained for seven years from the date of last contact, in line with standard professional practice, after which they are securely deleted.

Cancellation and rescheduling

You may cancel or reschedule an appointment at no charge provided you give at least 48 hours notice. To cancel or reschedule, please email [email protected].

If you cancel or reschedule with less than 48 hours notice, the full session fee will be charged. In exceptional circumstances — such as a medical emergency — we will consider the circumstances and may at our discretion waive the late cancellation charge.

If you arrive more than 20 minutes late for a session without prior notice, the session will be treated as a late cancellation and the full fee will apply.

We may cancel or reschedule a session in exceptional circumstances. If we do so, we will notify you as soon as possible and offer an alternative appointment. No charge will apply.

Refund policy — Reset Session

The Reset Session fee of £110 is payable at the time of booking. If you cancel with at least 48 hours notice, a full refund will be issued within 14 working days. If you cancel with less than 48 hours notice, no refund will be issued except in exceptional circumstances at our discretion.

Refund policy — Break the Loop

The Break the Loop programme fee of £880 is payable in full at the time of booking. If you cancel before your first session, a full refund will be issued within 14 working days.

Once the programme has started — that is, once your first session has taken place — no refund will be issued for any remaining sessions. This is because preparation, planning, and resources are committed to your programme from the point of booking.

In exceptional circumstances, we will consider requests on a case-by-case basis and may at our discretion offer a partial refund for unused sessions.

Confidentiality

Everything you share in your sessions and in your prep form is treated with full confidentiality. Information you share will not be disclosed to any third party except in the following circumstances:

  • Where disclosure is required by law or by a court of competent jurisdiction
  • Where there are concerns that you or someone else may be at risk of significant harm — in such circumstances Dr Nicola Sutton may be required to share information with the appropriate authority in line with her professional obligations

Where possible, any disclosure of this kind will be discussed with you first.

Nature of the sessions

The Reset Session and Break the Loop are practical, skills-based sessions focused on parenting patterns and behaviour change. They are not a substitute for professional support. If at any point it becomes clear that a different kind of support would be more appropriate for you, we will discuss this with you.

  1. Pricing and payment

Prices are displayed on the relevant product or booking page at the time of purchase. Payment is taken at the point of purchase or booking. Customers outside the UK are responsible for any currency conversion fees applied by their payment provider.

Prices may change at any time but changes will not affect purchases or bookings already completed.

  1. Testimonials and feedback

By providing feedback, a review, or sharing a result with us — whether by email, direct message, or any other means — you give permission for that content to be used in marketing materials and promotional activity.

Your full name will not be shared without your explicit permission. Where feedback is of a personal nature, discretion will be applied and it will not be shared publicly.

  1. Email communications

By purchasing a digital product or booking a session, you agree to receive transactional emails related to your purchase or booking. These are necessary to deliver the product or session and are not marketing communications.

Marketing emails are separate and require your consent. You can unsubscribe from marketing emails at any time using the link provided in every email.

  1. Data protection and privacy

We collect and process personal data in accordance with UK GDPR and the Data Protection Act 2018. When you purchase a product or book a session, we collect your name, email address, and payment details where applicable. This data is processed through third-party platforms including Kajabi, our booking system, and our email marketing provider.

We never share your personal data with third parties for their marketing purposes and we never sell your personal data to any third party.

You can request access to, correction of, or deletion of your data at any time by contacting [email protected].

For full details, please see our Privacy Policy.

  1. Third party links

Our products, sessions, and website may contain links to third party websites or resources. These links are provided for convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

  1. Availability and changes to products and services

We reserve the right to update, modify, or withdraw any digital product or session offering at any time. If a significant change is made to a product or programme you have purchased, we will notify you by email. We will make reasonable efforts to ensure products and sessions remain accessible but cannot guarantee uninterrupted access due to circumstances beyond our control.

  1. Limitation of liability

To the fullest extent permitted by law, Dr Nicola Sutton shall not be liable for any indirect, incidental, or consequential loss or damage arising from the use of or inability to use our digital products or sessions.

Nothing in these terms excludes or limits liability for:

  • death or personal injury caused by negligence
  • fraud or fraudulent misrepresentation
  • any other liability that cannot be excluded or limited by law

  1. Changes to these terms

We reserve the right to update these terms at any time. Any changes will be posted on this page with the date updated. Continued use of our products or services after changes have been posted constitutes acceptance of the revised terms.

  1. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

As a consumer, you will benefit from any mandatory provisions of the law in your country of residence. Nothing above takes away or reduces your rights as a consumer to rely on those provisions.
